Common Legal Mistakes Small Businesses Make In Advertising ...

An aspect of doing business that many small businesses may not be aware of is that there are stringent legal rules to follow regarding advertising. The FTC is the ruling government body that is tasked with making sure every business is following stated Federal guidelines. It doesn?t matter if you run a mom and pop or sophisticated business operation. Every business should know something about these laws in order to avoid inadvertently breaking the law. When an advertising law is broken ignorance is no defense against suffering stiff penalties. In addition to federal rules, your state also has certain laws concerning consumer protection.

Advertising is the lifeblood of many small businesses and without it they would have to close their doors. Along with advertising, though, comes a serious obligation to provide truthful information to the public. For instance, if a business is struggling to bring customers in the door, the owner cannot simply dream up a scheme that entices people with misleading promises. While there are a few unscrupulous businesses that knowingly violate consumer trust, most businesses make advertising mistakes out of pure ignorance of the law.

For example, as reported in American News Report , Millennium Labs recently won a false advertising case against drug screening lab, Ameritox. The judge ruled Ameritox had made false claims about their urine drug test process. Their reputation could take a nosedive.

Deceptive Advertising

Some of the biggest and most common mistakes that businesses make in their advertising falls under the label of deceptive advertising. There are plenty of ways to get into trouble here.

Using Free Offers

Lots of businesses advertise special offers that involve giving away an item free of cost. Consumers love this type of deal and freebies often bring eager people ready to spend money. These specials usually mean that the customer buys one item and gets a second item free. This is perfectly fine, unless, the business adds on additional charges to that free item. Suddenly, this item isn?t really free anymore. If there are going to be any additional fees to be paid along with an advertised freebie, this must be clearly stated in the ad. If it is not, this is considered deceptive.

Bait and Switch

One of the oldest advertising tricks in the book is to publicly advertise a sale on a popular item, luring in customers, and once they are in the store they are told the item is no longer available at the advertised low price. Often consumers are steered towards more expensive items. This is illegal. Also, you must make sure that your business has enough inventory in stock to cover an advertised sale. If the item is in high demand, but you quickly run out of it, you can be accused of bait and switch. Be sure to say in the ad that there is limited inventory to protect against accusations.

Endorsements and Testimonials

If a business is lucky enough to get an endorsement from a local or national celebrity, and they are being paid for said endorsement, this must be fully disclosed in advertising. Likewise, anytime a customer or other person provides a business with a testimonial, their statements must be completely truthful. Never fake any type of testimonial under any circumstances. The FTC is cracking down on businesses that do this. This rule also covers the use of photographs. You may not substitute a stock photo image for a real person. You can get into hot water fast if someone complains you?re using their image without their express legal permission. All product photos in advertisements must show it in normal use. Any photo retouching that is out of the ordinary must be fully disclosed.

Fannie and Freddie Halt Foreclosures for the ... - AOL Real Estate

Fannie and Freddie halt evictions over the holidays.

By Les Christie

Homeowners facing foreclosure just received an early Christmas present: They won't be evicted from their homes over the holidays.

Mortgage giants Fannie Mae and Freddie Mac announced Monday that they will suspend all bank repossessions beginning Dec. 17 and Dec. 19, respectively, and will not resume the evictions until Jan. 2, 2013.

"The holidays are a chance to be with loved ones, and we want to relieve some stress at this time of year," said Terry Edwards, Executive Vice President of Credit Portfolio Management, Fannie Mae.

According to Freddie spokesman Brad German, the suspension will not affect other pre- or post-foreclosure activities, such as the filing notices of default or the scheduling of auction sales. Fannie said in its press release that other legal and administrative proceedings will also continue.

Bank of America said it will also put a halt to foreclosure evictions both for loans it owns and for those it services for investors during the holiday period. Other large mortgage lenders, including JPMorgan Chase, Wells Fargo and Citibank, have postponed foreclosures during the holidays in the past, but have yet to say whether they will do so again this year.

The reprieve is separate from the previously announced moratoriums on foreclosure evictions for victims of Superstorm Sandy in New York, New Jersey and Connecticut, which will continue through February.

5 Factors To Consider When Selecting Website Hosting ...

Whenever it concerns hosting service, there are numerous impartial critical reviews online and you may make your choice following on from the demands. However concurrently, a lot of website hosting companies have realized from the need for article promotion, as a result, many paid articles surface online and you do not know which exactly website hosting company is trustworthy indeed. Therefore, I publish this informative article to be able to be useful for finding the high-quality hosting services. Listed below are fivr elements that you ought to consider when selecting internet hosting services that suits your preferences.

Do you know you could better and boost the efficiency of the web site if you are using Virtual dedicated server internet hosting rather then what about a shared web-site such as you was used to this all while. The primary reason due to this is that most of the web business that are in function must have a lot of resources to enable them to out and many space which is of course not sufficient using the shared hosting facilities that they can has been employing. With a shared hosting server, it is virtually impossible to get a firm to work simply because they will basically be utilizing and sharing precisely the same web server with many hundreds of other internet businesses.

When choosing a website hosting, the volume of data transfer rate you pay for might be imperative to the achievements of your site. Usually, greater data transfer you have, greater traffic your site can cope with previously. Before time, normally, data transfer source is not cheap. Yet at present, thankfully, data transfer useage is getting increasingly less expensive. Many webhosting businesses guarantee they can deliver unlimited bandwidth, normally, which might be not reliable. So you ought to be attentive before purchasing one service provider that tells you the services are bandwidth-unlimited.

There has to be an at the least 99%up-time. Try your better to decide on the hosting service without down-time. Luckily, while using progression of relevant technology, most website hosting service providers have given nearly 99% up time assurance.

As we all know, cPanel is among the most popular cp. Windows platform is yet another popular cpanel. cPanel does offer more features when compared to Windows, also it?s simpler to use. In choosing web hosting services, be sure you pick the the one that that you are most accustomed to or fits your company online demands. For instance, if you intend to make your blog with Zblog, Windows hosting will be your most suitable choice because Z-blog is just not friendly with Linux hosting.

This aspect isn?t as vital elements. And yet big disk drive space is a basic of high quality internet hosting services. Presently, hardware has grown to be so low-cost that almost all website hosting providers have offered limitless diskspace limitation. For most varieties of web-sites, you don?t need to repay much focus to hard disk space, but if you?re planning to build data file sharing or video web sites, then will need lots of disk space.

There are numerous types of website hosting, for instance shared hosting, dedicated website hosting, VPS website hosting ultrahosting, managed web hosting, Linux web hosting or special business enterprise web hosting service for online business, etc and it is apparent you could buy website hosting at different fees. The larger the price, the better the quality of the product or service. This is the truth during our lifestyle. But you can choose a proper hosting service following your necessities, and that is wiser as compared to opting for dedicated web hosting service should you just want to start a private weblog. find out more

Why Sheldon Adelson Will Matter in 2016

DEAR ABBY: I'm married to the girl of my dreams. She's the best thing that's ever happened to me. We both work in the medical field. She's an emergency room nurse, and I'm a paramedic/firefighter.For several years my wife worked the day shift at a hospital more than an hour away from home. I tried to convince her to find a job closer, so we could see each other more. Finally, she told me she had been offered a night shift position at the hospital here in town. She promised to switch to a day shift if one opened up. I thought that was great. ...

Stocks edge lower after weak manufacturing report

(AP) ? Stocks edged lower on Wall Street Monday after a surprisingly weak manufacturing report heightened concern that fiscal deadlock in Washington is already hurting the economy.

The Dow Jones industrial average fell 59.98 points to close at 12,965.60. The Standard and Poor's 500 dropped 6.72 points to 1,409.46. The Nasdaq composite was down 8.04 points to 3,002.20

U.S. manufacturing declined in November to its weakest level since July 2009, the Institute for Supply Management reported. The ISM's index fell to 49.5 from 51.7 a month earlier, below the 51.2 reading forecast by analysts. Any number below 50 on the scale means that manufacturing is contracting. Businesses expressed concerns about the "fiscal cliff," a series of sharp government spending cuts and tax increases scheduled to start Jan. 1 unless an agreement is reached to cut the budget deficit.

"The ISM numbers probably took a little air out of what was some hope for better news on where the economy is going," said Jim Dunigan, executive vice president at PNC Wealth Management in Philadelphia. "We're still in the camp that this gets resolved and we don't go over the cliff, but there's a lot of angst between now and then."

The White House and Congress are still seeking to hammer out a budget deal that will avoid the "cliff." Republicans, led by House Speaker John Boehner, have balked at President Barack Obama's opening proposal of $1.6 trillion in higher taxes over a decade, a possible extension of the temporary Social Security payroll tax cut and heightened presidential power to raise the national debt limit.

House Republicans on Monday proposed their own 10-year blueprint to President Barack Obama that calls for increasing the eligibility age for Medicare and lowering cost-of-living hikes for Social Security benefits.

"There's a sense of insecurity until the President and Boehner get their act together," said Ben Schwarz, chief market strategist at New York-based brokerage Lightspeed Financial. "If they put together a package in short order, if they do it in the next couple of weeks, you'll see a strong rally."

Stocks have fluctuated since the Nov. 6 election as investors worried that a deal may not be reached in time to avoid the tax hikes and spending cuts, which economists say could push the U.S. back into recession. The S&P 500 is still 1.3 percent below its closing level on the day that Americans went to the polls, having fallen as much as 5 percent in the weeks following the election.

Wall Street opened higher Monday following news that manufacturing in China, the world's second-largest economy, grew for the first time in 13 months and after Greece announced details of a bond buyback program. The Dow had been up as much as 62 points shortly after the opening bell.

December is historically the best month for stocks. The S&P 500 has advanced an average of 2 percent over the past 30 years during the month of December, according to research from Schaeffer's Investment Research. The next best month is April, with an average return of 1.7 percent. The worst month is September, where investors lose an average of 0.7 percent.

The yield on the 10-year Treasury note rose 1 basis point to 1.62 percent.

Other stocks making big moves:

?Dell rose 42 cents, or 4.4 percent, to $10.06 after Goldman Sachs raised its rating to "Buy" from "Sell." Goldman cited Dell's healthy cash balance and said a recent decline in the stock may have been overdone. Dell has slumped this year as consumers migrated away from desktop PCs and laptops to portable devices such as tablets and phones.

? Health Management Associates fell 45 cents, or 5.7 percent, to $7.50 after the CBS news program "60 Minutes" broadcast a segment critical of the company's patient admission policies. The program included interviews with former employees who said HMA pressured its emergency room doctors to admit patients.

?Supervalu jumped 30 cents, or 12.6 percent, to $2.68 following a report that private equity firm Cerberus is considering multiple options for buying parts of the struggling grocery store chain.

Final DSM 5 Approved by American Psychiatric Association | World ...

Final DSM 5 Approved by American Psychiatric AssociationYesterday, the board of trustees of the American Psychiatric Association (APA) approved a set of updates, revisions and changes to the reference manual used to diagnose mental disorders. The revision of the manual, called the Diagnostic and Statistical Manual of Mental Disorders and abbreviated as the DSM, is the first significant update in nearly two decades.

Disorders that will be in the new DSM-5 ? but only in Section 3, a category of disorders needing further research ? include: Attenuated psychosis syndrome, Internet use gaming disorder, Non-suicidal self-injury, and Suicidal behavioral disorder. Section 3 disorders generally won?t be reimbursed by insurance companies for treatment, since they are still undergoing research and revision to their criteria.

So here?s a list of the major updates?

Overall Changes to the DSM

According to the American Psychiatric Association?s statement, there are two major changes to the overall DSM ? the dumping of the multiaxial system, and rearranging the chapter order of disorders. Most clinicians only paid attention to Axis I and II, so it?s no surprise the Axis system was never a big hit. The current chapter order has always been a bit of a mystery to most clinicians, so it?s good to know there?s some thought going into the new order of chapters.

Chapter order:

DSM-5?s 20 chapters will be restructured based on disorders? apparent relatedness to one another, as reflected by similarities in disorders? underlying vulnerabilities and symptom characteristics.

The changes will align DSM-5 with the World Health Organization?s (WHO) International Classification of Diseases, eleventh edition (ICD-11) and are expected to facilitate improved communication and common use of diagnoses across disorders within chapters.

Removal of multiaxial system:

DSM-5 will move to a nonaxial documentation of diagnosis, combining the former Axes I, II, and III, with separate notations for psychosocial and contextual factors (formerly Axis IV) and disability (formerly Axis V).

Specific Disorders

Autistic disorders will undergo a reshuffling and renaming:

?[Autism] criteria will incorporate several diagnoses from DSM-IV including autistic disorder, Asperger?s disorder, childhood disintegrative disorder and pervasive developmental disorder (not otherwise specified) into the diagnosis of autism spectrum disorder for DSM-5 to help more accurately and consistently diagnose children with autism,? according to an APA statement Saturday.

The rest of this update comes from the APA?s news release on the changes:

Binge eating disorder will be moved from DSM-IV?s Appendix B: Criteria Sets and Axes Provided for Further Study to DSM-5 Section 2. The change is intended to better represent
the symptoms and behaviors of people with this condition.

Disruptive mood dysregulation disorder will be included in DSM-5 to diagnose children who exhibit persistent irritability and frequent episodes of behavior outbursts three or more times a week for more than a year. The diagnosis is intended to address concerns about potential over-diagnosis and overtreatment of bipolar disorder in children.

Excoriation (skin-picking) disorder is new to DSM-5 and will be included in the Obsessive-Compulsive and Related Disorders chapter.

Hoarding disorder is new to DSM-5.

Its addition to DSM is supported by extensive scientific research on this disorder. This disorder will help characterize people with persistent difficulty discarding or parting with possessions, regardless of their actual value. The behavior usually has harmful effects ? emotional, physical, social, financial and even legal ? for a hoarder and family members.

Pedophilic disorder criteria will remain unchanged from DSM-IV, but the disorder name will be revised from pedophilia to pedophilic disorder.

Personality disorders:

DSM-5 will maintain the categorical model and criteria for the 10 personality disorders included in DSM-IV and will include the new trait-specific methodology in a separate area of Section 3 to encourage further study how this could be used to diagnose personality disorders in clinical practice.

Posttraumatic stress disorder (PTSD) will be included in a new chapter in DSM-5 on
Trauma- and Stressor-Related Disorders.

DSM-5 pays more attention to the behavioral symptoms that accompany PTSD and proposes four distinct diagnostic clusters instead of three. PTSD will also be more developmentally sensitive for children and adolescents.

Removal of bereavement exclusion:

The exclusion criterion in DSM-IV applied to people experiencing depressive symptoms lasting less than two months following the death of a loved one has been removed and replaced by several notes within the text delineating the differences between grief and depression. This reflects the recognition that bereavement is a severe psychosocial stressor that can precipitate a major depressive episode beginning soon after the loss of a loved one.

Specific learning disorder broadens the DSM-IV criteria to represent distinct disorders which interfere with the acquisition and use of one or more of the following academic skills:
oral language, reading, written language, or mathematics.

Substance use disorder will combine the DSM-IV categories of substance abuse and
substance dependence. In this one overarching disorder, the criteria have not only been combined, but strengthened. Previous substance abuse criteria required only one symptom while the DSM-5?s mild substance use disorder requires two to three symptoms.

The APA board of trustees also outright rejected some new disorder ideas. The following disorders won?t appear anywhere in the new DSM-5:

  • Anxious depression
  • Hypersexual disorder
  • Parental alienation syndrome
  • Sensory processing disorder

Although clinicians are ?treating? these concerns, the board of trustees felt like there wasn?t even enough research to consider putting them in Section 3 of the new DSM (disorders needing further research).

So there you have it. What do you think about these final decisions for the DSM-5?

?
